Agreement to Terms

By accessing or using NailSense (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

NailSense is an AI-powered mobile application that provides:

AI-generated nail art designs based on user-uploaded photos
Virtual nail shape try-on features
Custom style generation from text prompts
Nail health analysis and recommendations
Personalized weekly glow up plans

The App is provided by eyay.app ("we," "us," or "our").

Eligibility

You must be at least 13 years of age to use NailSense. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian to use the App.

Acceptable Use

You agree to use NailSense only for lawful purposes and in accordance with these Terms. You agree NOT to:

Upload photos of other people without their consent
Upload inappropriate, offensive, or illegal content
Use the App to harass, abuse, or harm others
Attempt to reverse engineer or copy the App's AI models
Use automated systems to access the App
Interfere with the proper functioning of the App
Violate any applicable laws or regulations
Infringe on intellectual property rights

User Content

Your Content

You retain ownership of any photos or content you upload to NailSense. By uploading content, you grant us a limited, non-exclusive, royalty-free license to:

Process your photos to generate nail art designs
Analyze your photos for nail health assessment
Store your content as necessary to provide the service
Use anonymized data to improve our AI models

Responsibilities

You are solely responsible for the content you upload and warrant that:

You own or have the necessary rights to the content
The content does not violate any laws or third-party rights
The content does not contain malware or harmful code

AI-Generated Content

NailSense uses artificial intelligence to generate nail art designs. You acknowledge that:

AI-generated results may vary and are not guaranteed to meet specific expectations
Results are for inspiration and visualization purposes
AI-generated designs should not be considered professional nail art advice
You may use AI-generated designs for personal, non-commercial purposes

Nail Health Analysis Disclaimer

Important: The nail health analysis feature is for informational and educational purposes only. It is NOT a substitute for professional medical advice, diagnosis, or treatment. Always consult with qualified healthcare professionals regarding nail health concerns.

Intellectual Property

The App and its original content, features, and functionality are owned by eyay.app and are protected by international copyright, trademark, and other intellectual property laws. You may not:

Copy, modify, or distribute the App
Reverse engineer or decompile the App
Remove any copyright or proprietary notices
Use our trademarks without permission

Subscriptions and Payments

Some features may require a paid subscription. By purchasing a subscription:

Subscriptions automatically renew unless cancelled
You will be charged through your App Store or Google Play account
Cancellation must be done at least 24 hours before renewal
Refunds are subject to App Store and Google Play policies
Prices may change with notice

Termination

We reserve the right to suspend or terminate your access to NailSense at any time, without notice, for:

Violation of these Terms
Fraudulent or illegal activity
Abuse of the service
Any other reason at our discretion

You may stop using the App at any time. Upon termination, your right to use the App will immediately cease.

Disclaimers

NailSense is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

Merchantability or fitness for a particular purpose
Accuracy or reliability of AI-generated content
Uninterrupted or error-free operation
Security of data transmission

Limitation of Liability

To the maximum extent permitted by law, eyay.app shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of data or profits
Business interruption
Damages arising from use or inability to use the App
Reliance on AI-generated content or health analysis

Indemnification

You agree to indemnify and hold harmless eyay.app and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of another party
Content you upload to the App

Third-Party Services

The App may integrate with third-party services (e.g., App Store, Google Play, analytics providers). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

Changes to Terms
